On Crypto Tax, Who Could Have Seen This Coming?

Illinois Democrats' controversial new cryptocurrency tax has been delayed six months amid an ongoing legal battle over whether the tax can be enforced.

Who could have seen this coming?

In the final hours of the legislative session, Democrats approved a series of new taxes as part of roughly $800 million in additional revenue measures to support the largest budget in Illinois history.

Record new taxes for record spending.

Democrats' controversial new taxes include:
  • Fantasy Sports Tax
  • Crypto Tax
  • Digital Ad Tax
  • Social Media Tax
  • Prediction Market Tax
These taxes target businesses and industries operating in Illinois, with concerns that at least some of the added costs could ultimately be passed along to consumers.

And now, one of those taxes is already tied up in court.

The crypto tax, originally scheduled to take effect January 1, 2027, has been delayed until July 1, 2027, while litigation challenging the measure continues.

House Republicans called for the repeal of these new taxes during a press conference last week. State Representative John Cabello's HB 5798 would repeal the Digital Asset Tax Act entirely.

So why spend taxpayer dollars defending a controversial new tax in court when lawmakers can simply repeal it?

House Republicans are calling on Democrats to take up Rep. Cabello's bill during veto session and repeal the crypto tax rather than continue defending it through litigation.

Illinois families and businesses are already paying enough. Springfield should be looking for ways to lower costs, not inventing new ways to raise them.
